    Specialists in Recruitment Debt Recovery

Sterling Debt Recovery has been collecting debts for recruitment agencies since 2007. The recruitment sector is the main focus of our debt collection business, and we have experienced debt collectors dedicated solely to our recruitment agency clients. We work for over 300 agencies as and when they need us with our clients ranging from sole traders to $1.5bn turnover multi-nationals.

Our agents have a thorough understanding of the sector’s terms of business (whether they be based on APSCo, REC, ARC terms or similar) and the usual disputes and excuses that arise. This allows us to explain the legal situation to the debtor including their contractual responsibilities and the consequences and costs of litigation. We are able to persuade the debtor that it is in their best interest to resolve the matter with Sterling rather than progress to court action. In the vast majority of cases this leads to full payment without the need for legal action meaning that our client gets paid quickly and cost effectively.

    Commission only debt collection

Sterling work on a no-win, no-fee basis with no up-front charges. In the majority of cases we are able to add late payment interest, fees and costs of recovery to the debt so that the debtor effectively covers our commission fee. We pursue the maximum debt value allowed by your terms of business and statute. For example where your client has negotiated a discount but has breached your contract, then usually we can pursue the higher fee.

Disputed debts and back door cases

In the recruitment sector invoices are often disputed rather than being simple non-payment. Sterling are experts at resolving disputes to achieve payment, including

    • Temp to perm fees.
    • The candidate leaves within the rebate period but the debtor has breached your contract (by non-payment) cancelling their right to the rebate or replacement candidate.
    • The debtor employs the candidate via another agency after our client has sent in the candidate’s CV.
    • The debtor has used a separate business to hire the candidate or has referred the candidate to another company.
    • Back door hire cases.

You can find final demand letter templates and useful advice on how to resolve disputes and protect yourself from bad debts on our Tools for Recruiters page and you can see case studies including some of the examples above here.

    Back Door Hire Placements

Missed fees due to back door hire engagements is a huge problem for recruiters. Sterling has developed HireChecker, our back door hire finder service. HireChecker allows recruiters to track down back door hire placements quickly and cost effectively on a commission only ‘fee per find’ basis.

    Legal advice and debt litigation

Where litigation is needed to collect a debt Sterling will discuss the merits and risks of such action with our customer and advise as to whether a positive cash outcome is likely. Our solicitor* has over 10 years’ experience in debt litigation for the recruitment sector so is able to analyse and put together a strong case efficiently and cost effectively. The strength of our submissions means the majority of cases are settled without going to court.

As weaknesses in a recruiter’s process or terms of business can create loopholes, which can allow disreputable clients to avoid payment, Sterling are able to review of your terms of business and process to put you in best standing to achieve full payment.
